The following are the Customer Terms and Conditions ("Agreement"), which govern your acquisition of services from AmericaGoesFSBO.com. Please read them carefully. BY ELECTRONICALLY SIGNING THIS AGREEMENT AND FILLING OUT THE INFORMATION, YOU ARE DECLARING THAT YOU ARE ELIGIBLE FOR A HOME SELLER ACCOUNT ("Account") AND THAT YOU AGREE TO ABIDE BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. An Account is granted to you with condition that you accept without modification all the terms, conditions, and notices contained within the Agreement below.

24HourCoupon, Inc., a New Jersey corporation ("Company"), owns and maintains AmericaGoesFSBO.com. The Company may revise these terms and conditions at its discretion. The revised writing will be effective as of the date of posting and will supersede any prior versions. By continued use of your Account, you accept the revised terms and conditions as set by the Company. Please frequently visit this page and review any changes in the terms and conditions of your Account.

• Requirements. You must be a legal owner of the property in whole or in part and have the permission of all other owners of the property to offer a property for sale on this web site.

• Information You Submit. It is important that you submit valid information. You may not impersonate or misrepresent your identity. The Company may, at its discretion, terminate any listing and Account obtained via false information.

• Account Transfers. Your Account is NOT transferable. All passwords and accounts are personal to our Customers and may not be transferred to anyone. You and any other legal owners of the property are the only persons permitted to use your password and Account. You may not permit anyone else to use your password or Account nor may you use anyone else's. It is your responsibility to keep the information confidential. Under no circumstances will the Company be held liable for any loss or damage as a result of any disclosure of your password or Account.

• Comply With Laws. As a condition of your Account, you represent to the Company that at all times you will comply with all local, state, national or international laws and regulations that may restrict your Account with AmericaGoesFSBO.com. You further agree that you are solely responsible for all acts or omissions that result from your Account with AmericaGoesFSBO.com.

• Your Property Listing on This Site. Your property listing on this site will remain visible by visitors at all times regardless of the current listing status.  When the sale of your property closes and title is transferred, you must login to your Account and change your Property Status to "Sold."  As is true with any real estate marketing company, results of your listing on this site are not guaranteed.

• Withdrawal of Listing. It is your right to withdraw your listing at any time. To withdraw your listing you must log in to your Account and change your Listing Status to "Withdrawn."  At that point your personal contact information will be hidden by our system but your listing and street address will still be available for viewing on our web site.

• Termination Of Account. To the full extent allowed by applicable law, the Company at its sole discretion, at any time, with or without justification, with or without notice, may refuse to accept new Accounts and/or terminate any Account for any reason whatsoever. The Company is not obligated to maintain any content in your Account.

• Your Relationship With The Companies We Advertise. Your individual relationship with our advertisers including, but not limited to, any dealings with the advertisers or their advertisers, participation in promotions, discounts, contests, and any other terms, conditions, warranties or representations associated with such dealings, is strictly between you and the advertiser. You agree to hold 24HourCoupon, Inc. harmless for any loss or damage of any kind incurred as the result of your dealings or as the result of the content provided by the web sites of the advertisers of AmericaGoesFSBO.com.

• Additional Advertising of Your Listing. You authorize the Company to advertise your home for sale in media other the your Internet listing on this web site. The additional media may include and is not limited to newspaper display ads, weekly "homes" magazines, etc. Photos of your home will be used and interested buyers will be directed back to AmericaGoesFSBO.com for more details. The intention of this additional advertising is done to help promote AmericaGoesFSBO.com and is done at the expense of the Company.

• Indemnification. You agree to indemnify and hold the Company, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your Account with AmericaGoesFSBO.com.

• Disclaimer Of Warranties. YOU EXPRESSLY AGREE THAT USE OF THE AMERICAGOESFSBO.COM WEBSITE ("THE SERVICE") IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL CONDITIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE.

• Limitation Of Liability. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER THE COMPANY NOR ANY OF ITS PARENTS, MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS CUSTOMER AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  In the event you are not satisfied with the service provided by AmericaGoesFSBO.com, products, services or promotions made available by the Service, the sole and exclusive remedy available is to login to your Account and change your Listing Status to "Withdrawn."

  The Company does not represent or warrant that your access to your Account will be uninterrupted or error-free, that defects will be corrected, or that the Account or the server that makes it available, are free of viruses or other harmful components. The Company does not warrant or represent that the use or the results of the use of your Account or the advertisements, promotions or discounts offered are correct, accurate, timely, or in any way reliable. You expressly agree that the Company shall not be liable for any unauthorized access to or modification of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered by you. You further agree that the Company shall not be responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights.

• Force Majeure. The Company will not be in default or otherwise liable for any delay or failure in its performance under this Agreement where such delay or failure arises by reason of an Act of God, or any government or governmental body, acts of war, the elements, strikes or labor disputes, power or system failures, failure of the Internet, computer hacking, or other causes beyond the control of the Company.

• Governing Law And Other Terms. Any action related to this Customer Agreement will be governed by the law of the State of New Jersey. Any action relating to this Customer Agreement shall be brought in the state or federal courts located in Middlesex County, New Jersey, and you hereby submit to the exclusive jurisdiction and venue thereof. You expressly agree to fully comply with all applicable laws of the State of New Jersey and the United States.
